DISCO Merchant Partner Agreement

Welcome to the DISCO Network! Our goal is to drive new foot traffic to your business and build loyalty with the local community. To ensure a great experience for both your staff and our users, we require all partners to agree to the following terms before activating their profile.

By creating a DISCO Business Account and clicking "Submit" you (the "Partner") agree to the following terms with DISCO (VS EVENTS Inc):

1. The "Must Honor" Pledge

You agree to honor the specific discount, deal, or reward currently active on your DISCO Partner App/Portal for any user who presents a valid DISCO app screen at the point of sale. You are fully responsible for managing, updating, or pausing your live offers through your merchant dashboard.

2. Staff Awareness & Account Management

You agree to inform and train your front-of-house staff, servers, and cashiers about the DISCO app and how to process your active discounts. (We want to avoid any awkwardness at the register!). You are also responsible for maintaining the security of your DISCO login credentials.

3. The Zero-Fee Launch Guarantee

Participation in the DISCO platform is currently provided at $0 monthly cost and 0% commission to the Partner. DISCO reserves the right to introduce fees in the future, but guarantees that you will receive at least thirty (30) days' written notice (via email and in-app notification) before any fees are implemented. You will never be charged automatically without your explicit consent.

4. Marketing & Media Release

To help us effectively promote your business to our users, you grant DISCO a non-exclusive, royalty-free license to use your brand name, logo, menu items, and publicly available photographs in the DISCO app, website, and our social media marketing campaigns (e.g., Instagram, TikTok).

5. Event Listings (Nightclubs Only)

At this time, the ability to create and list specific events (such as ticketed parties, guest lists, or live shows) on the DISCO platform is restricted exclusively to registered Nightclub and specific nightlife partners. Other business types (such as dining, retail, or wellness) may actively use standard flash deals and loyalty rewards, but cannot post events until this feature is formally expanded.

6. Cancellation Policy (No Lock-ins)

You can leave the platform at any time. However, to ensure a seamless experience for users who may be on their way to your business, we require seven (7) days' notice to fully deactivate your profile. You can initiate this by turning off your offers in the app or emailing partners@disco.deal.

7. Digital Agreement & Governing Law

By clicking "Submit" you confirm that you are an authorized representative of the business and have the authority to enter into this agreement. This agreement is governed by the laws of the Province of British Columbia, Canada.

8. Data Privacy & Security

You acknowledge that through the use of the DISCO platform, you may receive access to certain user information (the "User Data"). To protect the integrity of the DISCO community, you agree to the following:

  • Compliance: You agree to comply with all applicable privacy laws and DISCO's official Privacy Policy as updated from time to time.
  • Limited Use: You shall use User Data strictly for the purposes of (a) verifying valid transactions and (b) administering your specific loyalty program within the DISCO app. Use of this data for any marketing outside of the DISCO platform is prohibited without explicit user consent.
  • Non-Disclosure & No-Sale: You are strictly prohibited from selling, renting, or sharing User Data with any third parties.
  • Safeguarding: You agree to implement reasonable administrative and technical security measures to protect User Data from unauthorized access, loss, or theft.
  • Breach Notification: In the event of any unauthorized access to User Data via your merchant account or systems, you must notify DISCO immediately at partners@disco.deal.

9. Platform Moderation & Offer Control

While the Partner retains responsibility for creating and managing their live offers, DISCO maintains ultimate editorial control over the platform. We reserve the right, at our sole discretion and without prior notice, to edit, pause, or delete any discount, reward item, or event listing if we determine that it contains errors, is misleading to users, violates our platform standards, or otherwise negatively impacts the DISCO user experience.
